Online Auction Rules

  1. Bidders must be 18 years of age or older and possess a valid credit card from VISA or MasterCard.
  2. Bids may be entered on-line until 12 noon on December 30, 2005.
  3. All bids must conform to the minimum bid and bid increment requirements for the item offered, and bids must be made in U.S. dollars.
  4. Bidders must provide all information requested in the on-line bid form, including a telephone number where they can be reached on the afternoon of December 30th.  Bids accompanied by incomplete or invalid information will be disqualified.
  5. All bids are actual bids – no “up to” amounts will be accepted. If your bid is accepted, you agree to pay the full amount of your bid, not the amount of the next highest bid plus the minimum bid increment.
  6. ASP reserves the right to disqualify bids clearly intended to disrupt the auction.
  7. The website will be updated periodically to reflect the highest bid received for an item and the initials of the high bidder.
  8. Bidders may submit multiple bids for an item, and may bid on any and all items.
  9. The on-line auction will close at 12 noon on December 30th, 2005.  That afternoon, ASP will contact the highest bidder for each item to collect credit card information.  In the event of a tie, the earliest bid submitted will be considered the highest bid.  If a bidder cannot be reached on December 30th, his/her bid will be disqualified and ASP will contact the next highest bidder.
  10. All auction items will be available for continued bidding during the ASP Gala on December 31. The highest online bid, if any, will be shown as the first bid on the item. If the on-line bid is not exceeded during the Gala auction, the on-line bidder will be the winner of that item and his/her credit card will be charged immediately.
  11. Winning on-line bidders will be contacted no later than 5:00 PM January 2, 2006. Non-winners will not be contacted, however the winning bid will be posted on the Auction website.
  12. Winning bidders must pick up their items from ASP’s office in Cambridge no later than January 15, 2006. If you cannot pick up your item, you will need to make delivery arrangements at your own expense, and ASP does not assume any risk, liability or responsibility for those arrangements. ASP reserves the right to dispose of auction items in any manner if those items remain in our possession after January 15, 2006.
  13. All items are offered in “as is” condition and are subject to the restrictions imposed by the seller. Neither the Actors' Shakespeare Project (ASP) nor the Gala Committee provide any warranty, either written or implied, as to the condition, completeness, authenticity or value of the auction items. Once an item is purchased no refunds or exchanges will be made. Certificates issued for services or products are not negotiable for cash and are not replaceable if lost. Values indicated are those assigned by the donors and are not warranted by ASP for tax purposes or for general value. By his or her purchase, the buyer waives any claim for liability against ASP or the Committee that may result from the utilization of property or services sold. ASP reserves the right to withdraw any auction item for any reason prior to the close of the auction.
  14. All gift certificates and offers of services expire one year from the date of the Gala (December 31, 2006) unless the donor explicitly states otherwise or specific arrangements are made directly between the donor and the purchaser. All offers of service must be performed within a 100 mile radius of the city of Boston unless the donor explicitly states otherwise or specific arrangements are made directly between the donor and the purchaser. All copyrights for artwork remain with the artist unless otherwise stated in writing.
  15. By bidding you acknowledge your acceptance of the terms outlined above.
